Agreement to Terms

By accessing our website at oceansidehomewatch.com or engaging our home watch and property management services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services. These Terms of Service constitute a legally binding agreement between you and Oceanside Home Watch LLC.

Description of Services

Oceanside Home Watch LLC provides professional home watch, estate management, property management, access management, and concierge services for residential properties in the Vero Beach, Florida area. Our services include but are not limited to:

• Regular property inspections during owner absence
• Visual inspection of property systems (HVAC, plumbing, electrical)
• Vendor and contractor coordination
• Emergency response and notification
• Mail and package handling
• Pre-arrival and post-departure preparation
• Storm preparation and post-storm assessment

Service Limitations

Our home watch services are visual inspections only and are not intended to replace professional inspections, appraisals, or maintenance services. Important limitations include:

• We do not perform repairs, maintenance, or construction work
• We are not licensed contractors, electricians, plumbers, or HVAC technicians
• We cannot guarantee detection of all issues, particularly those not visible during routine inspections
• We do not provide security guard services or 24/7 monitoring
• We are not responsible for pre-existing conditions or latent defects
• Our services do not constitute insurance coverage

Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information about your property
• Maintain current contact information and emergency contacts
• Provide necessary access keys, codes, and security system information
• Maintain adequate homeowners insurance coverage
• Notify us of any changes to your property, travel plans, or contact information
• Respond promptly to our communications regarding urgent matters
• Pay for services in accordance with the agreed-upon payment terms
• Authorize us to take reasonable emergency action when we cannot reach you

Property Access

By engaging our services, you grant Oceanside Home Watch LLC permission to enter your property for the purpose of performing agreed-upon services. You authorize us to use keys, access codes, and other means of entry you have provided. We will secure your property after each visit and maintain the confidentiality of all access information. You agree to notify us immediately if access codes or locks are changed.

Fees and Payment

Service fees are established in your individual service agreement. General payment terms include:

• Monthly service fees are due on the first of each month
• Additional services outside the standard agreement may incur extra charges
• Late payments may result in service suspension
• We reserve the right to adjust fees with 30 days written notice
• Refunds are provided only as specified in your service agreement

Insurance and Liability

Oceanside Home Watch LLC maintains general liability insurance and is bonded for your protection. However:

• Our liability is limited to the scope of our insurance coverage
• We are not liable for acts of God, natural disasters, or circumstances beyond our control
• We are not liable for the actions of third-party vendors, even when coordinated by us
• Clients should maintain their own comprehensive homeowners insurance
• In no event shall our liability exceed the fees paid for services in the preceding 12 months

Indemnification

You agree to indemnify and hold harmless Oceanside Home Watch LLC, its owners, employees, and agents from any claims, damages, losses, or expenses arising from your breach of these Terms, your negligence, or inaccurate information you have provided. This includes any claims by third parties related to your property.

Confidentiality

We treat all client information as confidential. We will not disclose your personal information, property details, access codes, or security information to unauthorized parties. Our employees and contractors are bound by confidentiality agreements. This obligation continues after termination of services.

Termination

Either party may terminate services with 30 days written notice. We reserve the right to terminate services immediately if:

• Payment is more than 30 days overdue
• The property presents a safety hazard to our staff
• You provide false or misleading information
• You breach any material term of these Terms of Service

Upon termination, we will return all keys and access devices and delete stored access codes within a reasonable timeframe.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, hurricanes, floods, pandemics, government actions, civil unrest, or infrastructure failures.

Dispute Resolution

Any disputes arising from these Terms or our services shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Indian River County, Florida, in accordance with Florida law. Each party shall bear its own costs and attorney fees unless otherwise determined by the arbitrator.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action must be brought in the courts of Indian River County, Florida.

Website Use

Regarding use of our website, you agree not to:

• Use the website for any unlawful purpose
• Attempt to gain unauthorized access to any portion of the website
• Use automated systems to extract data from the website
• Transmit viruses or malicious code
• Interfere with the proper functioning of the website

Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of Oceanside Home Watch LLC and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Modifications
